Hypodermic Needle Possession

Trenton NJ Possession of a Hypodermic Needle or Syringe Lawyer

Law Firm with Offices in Pennington, New Jersey

New Jersey lawmakers and law enforcement take drug crimes very seriously. That’s why there are a number of laws on the books which criminalize drug paraphernalia and other instruments used to inject illicit drugs into the bloodstream. The most common instruments of this sort are hypodermic needles and hypodermic syringes. Many drug arrests in the State of New Jersey include charges for illegal possession of a hypodermic needle or syringe. You need to take these charges very seriously because NJ prosecutors often use these lesser offenses as leverage to get a harsher sentence imposed on a drug possession charge. If you have been accused of a drug crime and the charges include possession of a hypodermic needle, it is imperative that you speak with an experienced attorney.

N.J.S.A. 2C:36-6: Hypodermic Needle Possession Charges in Mercer County, NJ

N.J.S.A. 2C:36-6 makes it illegal for anyone in New Jersey to have under their control a hypodermic syringe or hypodermic needle. The statute is quite broad and covers a number of devices; as a result, the law also makes it unlawful for a person to possess any other instrument adapted for the use of a controlled dangerous substance (CDS).

Many hypodermic needle possession cases are accompanied by a related charge for possession of drug paraphernalia. These charges are very serious because you could be subject to additional penalties. Additionally, the stacking of drug charges in your case might make it easier for the prosecutor to seek jail time.

Penalties for Possession of a Hypodermic Needle in Lawrence, NJ

  • License Suspension: Loss of driving privileges in New Jersey for 6 months

Exceptions to the Hypodermic Needle Possession Law in Hopewell, NJ

New Jersey lawmakers carved out an exception for certain individuals who may need to use hypodermic needles or syringes in their line of work. These exempted individuals include physicians, dentists, veterinarians, undertakers, nurses, podiatrists, registered pharmacists, hospital workers, and medical supply dealers.

Additionally, the law provides exceptions for anyone who obtains the hypodermic needle or hypodermic syringe with a valid prescription. As long as the prescription was issued by a licensed physician, dentist, or veterinarian, the person obtaining the needle or syringe is legally allowed to use it for its authorized purpose. However, no prescription for a hypodermic needle or syringe is valid more than one year after the date of issuance; the person in legal possession of the device must get a new prescription each year.
