Pennsylvania Commercial DUI Law

The legal limit for anyone who operates a commercial vehicle in Pennsylvania is .04 percent blood alcohol concentration (BAC). This is lower than the standard BAC of .08 percent. Moreover, commercial drivers are subject to more severe penalties for DUI violations. Beyond that, it does not matter if the violation occurred in a personal vehicle; commercial drivers are held to a high standard in Pennsylvania and face enhanced penalties even if they commit a DUI in a personal motor vehicle.

CDL DUI Penalties in Bucks County

DUI offenses in Pennsylvania are typically sorted into categories based upon the offender’s blood alcohol concentration (BAC). However, commercial DUI offenders are automatically charged under the High Impairment category for DUI offenses; this is regardless of the driver’s BAC level.

First Offense:

Second Offense:

  • Jail: 1–6 months
  • Commercial License Suspension: Permanent suspension
  • Fine: $750–$5,000
  • Community Service: 150 hours
  • Alcohol and Drug Treatment: Enrollment in treatment program if recommended by evaluators
  • Alcohol Highway Safety School (AHSS): Mandatory enrollment in alcohol education classes

Third Offense:

  • Jail: 3 months–5 years
  • Fine: $1,500–$10,000
  • Community Service: 150 hours
  • Alcohol and Drug Treatment: Enrollment in treatment program if recommended by evaluators

Fourth Offense:

  • Jail: 1–5 years
  • Fine: $1,500–$10,000
  • Community Service: 150 hours
  • Alcohol and Drug Treatment: Enrollment in treatment program if recommended by evaluators

If the offender was transporting hazardous materials when the offense occurred, the penalties may be enhanced. A first-time offense can result in commercial license suspension for 3 years. A second offense will result in commercial license suspension for a minimum of 10 years, with the potential for a lifetime suspension.
