Princeton NJ Weapons Offenses on School Grounds Lawyer
With Offices in Trenton and Pennington, New Jersey
New Jersey weapons laws are among the strictest and most punitive in the entire country. As a result, anyone convicted of a weapons offense in the State of New Jersey is subject to significant penalties that often include mandatory prison time. When the weapons offense occurs in an educational setting, the penalties are even more severe. That’s because NJ lawmakers impose strict liability on anyone caught in possession of a firearm or any other deadly weapon while in certain public places, such as the grounds of a school, college, university, or other educational institution. Even possession of an imitation firearm like a BB gun or an Airsoft gun on school grounds can result in a person being charged with a felony-level offense.

Weapons Offenses on Mercer County NJ School Grounds
It is against the law to carry any potentially deadly weapon on the grounds of a school, college, university, or other educational institution in New Jersey. It is also against the law to carry a weapon on a school bus in New Jersey.
Of course, these restrictions on weapons include firearms. This matters because even if you had a permit to carry the gun, you can still be charged with illegal possession on school grounds; these carry permits do not apply to educational settings. Additionally, it does not matter if you have a valid firearms purchaser ID card because you almost never have a legal right to carry a firearm on the grounds of an educational institution.
Carrying a Gun on School Grounds in Princeton NJ: A Strict Liability Offense
As set forth by N.J.S.A. 2C:39:5(e)(3), this is a strict liability offense. This means that unless you have written authorization from the educational institution, you are in violation of the law the moment you set foot on the school grounds with the weapon. In other words, your intent does not matter.
The only exception to this law is if the governing officer of the educational institution has provided written authorization for the person to carry the firearm on school grounds.
