Woman Sues Hamilton NJ Police Department for Causing Car Accident during Pursuit of Suspect

A woman recently filed a personal injury lawsuit against Hamilton Township, the Hamilton Police Department, and two Hamilton police officers after she was seriously injured in a car accident.

The lawsuit was filed in Mercer County Superior Court in Trenton, New Jersey. The plaintiff in the case is alleging that Hamilton police were responsible for the injuries she sustained during a motor vehicle accident in 2014.

The auto accident occurred on Gladstone Avenue in Trenton, NJ. The woman had parked a car on the side of the road and was in the process of buckling her children into the backseat when another vehicle crashed into her.

The driver of the other car was a criminal suspect being pursued by Hamilton patrol officers. The suspect was fleeing police when he lost control of his vehicle and slammed into the victim’s car, as well as a different car that was also on the roadway.

The victim sustained serious injuries in the car accident, requiring hospitalization and resulting in significant medical bills.

Now the victim is suing Hamilton Township for failing to adequately train police officers in how to pursue fleeing suspects. In her lawsuit, the plaintiff also alleges that the Hamilton NJ cops created an “unsafe and/or dangerous condition” when they pursued the suspect.

In addition to suing Hamilton NJ and the township’s employees, the victim also filed suit against the suspect who was being pursued by police at the time of the motor vehicle accident.

Depending on the evidence presented at trial, it is possible that the victim will be able to receive monetary compensation for her medical bills, in addition to compensation for the costs of the damage to her car.
